Terms of Service

Welcome to DetailProof. These Terms of Service ("Terms") govern your access to and use of the DetailProof iOS app, our website at detailproof.app, and any related services (collectively, the "Service"). By creating an account or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

DetailProof is a documentation tool for professional vehicle detailers. It helps you capture before-and-after photos, document vehicle condition, collect customer signatures, generate PDF reports, and store this information in your account. DetailProof is not insurance, is not a warranty, and does not adjudicate disputes between you and your customers. The reports generated by DetailProof are records you create.

2. Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for keeping your login credentials confidential and for everything that happens under your account. If you become aware of unauthorized use, contact us immediately at support@detailproof.app.

3. Subscriptions, free trial, and billing

The Service is offered on a subscription basis with a free trial. Subscriptions are processed through Apple's App Store using your Apple Account. By subscribing, you authorize Apple to charge the recurring fee at the price displayed at the time of purchase, until you cancel.

  • Free trial. If a free trial is offered, no charge will be made if you cancel before the trial period ends. After the trial, the subscription automatically renews at the displayed rate.
  • Auto-renewal. Your subscription renews automatically at the end of each billing period unless you turn off auto-renewal at least 24 hours before the end of the current period.
  • Cancellation. You can cancel anytime in your Apple Account → Subscriptions. Cancellation takes effect at the end of the current billing period; previously charged amounts are not refunded except where required by law.
  • Refunds. Refund requests for App Store purchases are handled by Apple under their refund policy. We cannot directly refund payments made through the App Store.
  • Price changes. We may change subscription prices, with notice required by Apple's terms. Continued use after a price change constitutes acceptance.

4. Acceptable use

You agree not to:

  • Use the Service for anything illegal, fraudulent, or in violation of any third party's rights, including privacy and intellectual-property rights.
  • Upload content that is unlawful, harmful, or infringing.
  • Reverse-engineer, decompile, or attempt to extract source code from the Service, except to the extent permitted by applicable law.
  • Probe, scan, overload, disrupt, or interfere with the Service or its infrastructure.
  • Resell, sublicense, or commercially redistribute the Service or any feature of it without our prior written consent.
  • Use the Service to build a competing product or train any machine-learning model.
  • Misrepresent your identity or impersonate any person or entity.

We may suspend or terminate accounts that violate these Terms.

5. Your content

You retain ownership of all content you upload to or create within the Service ("Your Content"), including photos, customer information, signatures, notes, and reports. By using the Service you grant DetailProof a worldwide, royalty-free license to host, store, transmit, display, and process Your Content solely to operate and improve the Service for you. We do not use Your Content to train artificial-intelligence models.

You represent and warrant that you have all rights necessary to upload Your Content, including any consents required from your customers under applicable privacy and image-rights laws.

6. AI-assisted features

The Service includes AI-assisted damage detection, which uses Anthropic's Claude API to analyze photos and surface possible damage. The findings produced by AI are assistive only and may be incomplete, inaccurate, or wrong. You remain solely responsible for reviewing photos, confirming what is and is not damage, and producing accurate documentation. AI findings are not omitted from internal app review screens but are intentionally excluded from customer-facing PDF reports unless you choose to add them yourself.

Do not rely on AI findings as a substitute for professional inspection, mechanical analysis, or legal evidence. DetailProof and its providers disclaim all liability arising from reliance on AI findings.

7. Customer data and your obligations as a detailer

You will use the Service to enter information about your customers and their vehicles. You are the controller of that information and we are the processor. You agree to:

  • Provide notice to your customers as required by applicable privacy law before collecting their information.
  • Honor customer rights (such as access, correction, and deletion requests) with respect to data you input.
  • Indemnify DetailProof from any claims arising from your collection or use of customer information.

8. Reports are not insurance

The PDF condition reports generated by the Service are not insurance and do not constitute a warranty, guarantee, or contract between DetailProof and any party. They are records of vehicle condition as documented by you at a particular point in time. Resolution of any dispute between you and your customer is solely between you and the customer.

9. Intellectual property

DetailProof, the DetailProof logo, the "Photo Proof Before Every Detail" tagline, and all related names, trademarks, and software are owned by DetailProof. You may not use them without our prior written consent, except to refer accurately to the Service. Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable license to use the Service for your business or personal documentation needs.

10. Third-party services

The Service relies on third-party providers including Apple, Google/Firebase, Anthropic, and Vercel. Your use of those providers is also subject to their terms. We are not responsible for the actions, terms, or content of third-party services.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS, OR THAT AI FINDINGS WILL BE ACCURATE OR COMPLETE.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DETAILPROOF AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) USD $100.

13. Indemnification

You agree to indemnify, defend, and hold harmless DetailProof and its providers from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use of the Service; (ii) Your Content; (iii) your violation of these Terms; or (iv) your violation of any third-party right, including any privacy or intellectual-property right.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms or if your account is inactive for an extended period. On termination, your access to the Service will end and we will delete your data subject to the retention timelines described in our Privacy Policy.

15. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts. Nothing in this section limits any non-waivable right you may have under applicable law.

16. Changes

We may update these Terms from time to time. If we make a material change, we will provide notice in the app or by email at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance.
